These terms govern use of Topupsell (“the app”), operated by TH Global Vietnam. Installing the app means accepting them. How the app handles buyer data is covered by the Privacy Policy and the Data Processing Agreement.

What the app does

The app shows offers to buyers after checkout and in the cart drawer, charges accepted offers through Shopify against the payment method already used, briefly delays fulfilment so an accepted offer ships in the same parcel, and reports conversion results in the merchant dashboard.

Eligibility and requirements

The merchant needs an active Shopify store and must select this app as their post-purchase app in Shopify checkout settings. Shopify does not show post-purchase offers on every order: orders paid with Apple Pay, Google Pay, PayPal, Klarna or a gift card, and stores with multiple currencies enabled, are excluded by the platform. These limits are Shopify’s, not the app’s, and cannot be worked around.

Merchant responsibilities

The merchant is responsible for the offers they configure: the products, the prices, the wording and any images they upload. The merchant must have the right to use that content, must price offers lawfully in their market, and must honour accepted offers as part of the order. The merchant is also responsible for their own store privacy policy and for any consent their buyers require.

Acceptable use

The app may not be used to charge buyers for anything they did not accept, to present misleading prices or savings, to bypass Shopify platform rules, or to attempt to reach data belonging to another store. Accounts used this way may be disabled without notice.

Fees

The app is currently provided free of charge. If a fee is introduced, it will be presented for approval through Shopify’s billing process before it applies, and continuing to use the app will be optional at that point.

Availability and support

The app is provided as-is, without a guaranteed uptime level. It depends on Shopify and on the hosting providers listed in the Data Processing Agreement; an outage in any of them can interrupt offers. Support is available at thvietnambtc@gmail.com with a response within 1 business day.

If an offer fails to display or a charge cannot be applied, the underlying order is unaffected: the buyer keeps what they originally purchased and is not charged for the offer.

Intellectual property

TH Global Vietnam retains all rights in the app. The merchant retains all rights in their own content — products, wording, images and funnel configuration — and grants the processor only the licence needed to display that content to their buyers and store it for the app to work.

Limitation of liability

To the extent permitted by law, TH Global Vietnam is not liable for indirect or consequential loss, including lost profit or lost revenue arising from offers that did not display. Nothing here limits liability that cannot be limited by law, including liability under applicable data protection law.

Termination

The merchant may stop using the app at any time by uninstalling it from their Shopify admin, which triggers deletion of their configuration and credentials as described in the Data Processing Agreement. TH Global Vietnam may suspend access for breach of the acceptable use section above, or where required by Shopify or by law.

Changes

These terms may change. Material changes will be published here with a new date above, and continued use after that constitutes acceptance.

Governing law

These terms are governed by the laws of Vietnam. Mandatory consumer and data protection rights under the law of the merchant’s own country are unaffected.
